Many ads are airbrushed to give the models the look of being flawless which many women and girls do not realize. When thinking about it, the whole point of a commercial is essentially to sell happiness. If selling happiness is the goal and the use of models is prevalent in the commercial, then it can be concl uded that the only way to achieve happiness is to be just like the commercial by having the product being advertised and looking like the person advertising it. These pressures from the media ads can lead to eating disorders. For many women and girls the â€Å"ideal image portrayed becomes an obsession and results in an eating disorder like anorexia or bulimia† (Karyn p.1). With the constant nagging to be thin, the dancers feel that if they are to be in music videos on television, they have to measure up to this false image of a woman.

In determining the liability of the parties, it is necessary that the following be first established by the claimant: a) duty; b) breach of duty; c) causation; d) injury. (â€Å"Tort† p. 1) It is clear that once a patient enters the premises of the hospital, an implied contract is thereby created and the hospital is under obligation to attend to the needs of the patient with due care and diligence. This duty was however breached when the hospital employees failed to provide immediate attention to the patient’s needs despite the urgency and immediacy of the situation. It is also clear that the delay of more than one hour from the time the patient was admitted to the hospital despite the finding that the patient needed to undergo immediate surgery is a breach of that duty of care. There is also a proximate cause between the breach and the injury suffered by the patient, which is partial paralysis of his hands. The question left to be determined is who is responsible for the damage suffered. In this case, the nurse committed a breach of her duty of care and was negligent. Instead of giving immediate medical attention to the patient, the nurse decided to first determine if the patient is covered by insurance. The surgeon also committed a breach of his duty of care and due diligence to patient. The medical profession is founded on the duty of due diligence which doctors owe to their patients. In this case, despite the finding of the need for immediate surgery the surgeon merely proceeded to his way without even referring the patient to other doctors who are on duty and who are not on break. The x-ray technologist was likewise negligent when he failed to deliver the x-rays to the radiologist for examination despite the urgency of the situation. The fact that there are other patients in the hospital is not an excuse since every hospital is required by law to have an adequate number of medical personnel to attend to the needs of all its patients. Finding that the hospital employees are negligent, the City General Hospital itself cannot escape its liability. Hospitals can no longer escape their liability under the doctrine of charitable immunity. Karen A. Dean, 1999 p. 1) Under the doctrine of resondeat superior, the negligence of its employees is imputed to them because they are the ones who have control and supervision of their employees. The fact that the hospital is not negligent is not a defense so long as it can be proven that its employees were negligent. Further the recent trend in the new cases is that it is no longer a defense that there is no employer-employee relationship between the physician or the x-ray technician or the nurse to escape its liability (Gene A. Blumenreich p. ) The immunity from liability of hospitals is being restricted by the recent cases. The 1992 case of Uhr vs. Lutheran General Hospital (226 Ill. App. 3d 236, 589 N. E. 2d 723) confirms that a hospital may be held liable for the negligent acts of an independent contractor. Consider also the 1993 case of Gilbert v. Sycamore Community Hospital where the Illinois Supreme Court abrogated the common-law immunity of hospitals for Independent Contractor negligence (156 Ill. 2d 511, 622 N. E. 2d 788) Ib. Yes. The Emergency Medical Treatment and Active Labor Act (EMTALA) applies in this case. The law imposes upon hospitals the obligation to provide medical screening examination to determine whether an emergency medical condition exists. (Daris McNelice p. 1) The failure to discharge this obligation renders the hospital liable for civil damages to the injury that the patient may suffer. In this case, the nurse who attended the patient when he arrived for treatment did not immediately conduct medical screening examination to determine the patient’s condition. The act of the nurse in providing the patient with a towel was far short of the obligation required by law. Instead the nurse made an inquiry whether the patient is covered by insurance. Though the law does not prohibit the hospital from inquiring into the ability to pay of the patient, it does require that this inquiry should not delay the conduct of the medical screening examination. The purpose of the law is clear which is to protect against discrimination against patients. This was violated in this case. The patient was lucky that he bumped into a surgeon who determined that he is in a serious medical condition. Despite this however, the hospital still failed to provide proper medical attention to the patient despite the finding that an emergency medical condition exists. Because of the hospital’s failure to comply with the provisions of the said law it may be held liable for damages. 2. The liability for negligence of the nurse, surgeon and the x-ray technologist is distinct and separate. Their liability is independent of each other. It is not a defense in tort cases that the negligence of one is superior to another. The only determining point is that there was a breach of duty committed by these hospital employees and that this breach was the proximate cause of the injury of the patient. As such, the patient who was injured may hold them liable together with the hospital in one suit. However, ordinarily the patients only file suit for damages against the hospital. In case he is able to recover, the hospital has the option of filing claims against these negligent employees who are solidarily liable for their negligence to the hospital. Yet prior to World War I (1914-1918) most firms regarded the purchase function primarily as a clerical activity. However during the world war, the ability to obtain raw materials supplies ad services needed to keep the factories and mines operating were the 3 key determinates of organizational success. This traction helps the wheels to propel the cars across further distances and at greater speeds. However, friction can also occur between the axles and the cars, which can be detrimental to performance. To combat this, lubricants are used on the axels where they are in contact with the chassis of the car. Also, more mass involved with the rotation of the axels will cause more friction. A two-feet length of nylon string was secured to the copper pipe and the rear axel. The wheels were attached to the axels with rubber cement. The various larger sizes were designed to fit over the smallest ones that were attached to the axels. Hundreds went to jail for these actions, but the protests were never stopped. India went through the same type of dedication and hard times for its independence that the activists that followed Martin Luther King Jr. had gone through for equal rights. As leader of the movement, Mohandas K. Gandhi was firmly committed to nonviolence. Gandhi believed it was not just a tactic for achieving social change; it was a way of life. That is why Gandhi is so well remembered. Gandhi called Thoreau’s â€Å"Civil Disobedience† essay â€Å"a masterly treatise† which â€Å"left a deep impression on me.† Later on Gandhi became unsatisfied with the term â€Å"passive resistance.† He noted,  Ã¢â‚¬Å"In a meeting of Europeans I found that the term â€Å"passive resistance† was too narrowly construed, that it was supposed to be a weapon of the weak, that it could be characterized by hatred, and that it could finally [show] itself as violence† Gandhi was so determined to make a change; he put out a call for suggestions for a new word to describe the Indian struggle. King was on a quest that he described as â€Å"a serious intellectual quest for a method to eliminate social evil.† He found this in a sermon by Dr. Mordecal Johnson, president of Howard University. King stated, â€Å"Dr. Johnson had just returned from a trip to India, and, to my great interest, he spoke of the life and teachings of Mahatma Gandhi. His message was so profound and electrifying that I left the meeting and bought half dozen books on Gandhi’s life and works.† Gandhi’s work led King’s first bus boycott in Montgomery, Alabama. On December 1, 1955, an African-American seamstress was seated in the back â€Å"colored section† of a crowded city bus. A man later came on the bus and could not find any other seats and asked the seamstress to move. This remarkable woman was Rosa Parks refusing to move and was promptly arrested.  This finally was the last straw for the people in Montgomery; King determined that the time was finally right. Martin Luther King Jr. and those who followed him knew that this ending was the beginning of a much larger struggle for true equality. It would be long and it would be difficult. Some people would grow impatient of the nonviolent actions and would want to end up fighting back, but this was the time to determine their real strength. King said, â€Å"The false impression. . . . the resister quietly and passively accepts evil. But nothing is further from the truth. . . The method is passive physically, strongly active spiritually. It is not passive nonresistance to evil, is active nonviolent resistance to evil.† The â€Å"active nonviolent resistance† that won the day in Montgomery would be severely tested when it faced the racism and bigotry that created those laws in the first place. That struggle would continue into the 1960s and beyond. As the world evolved the 1960s became an act of civil disobedience also known as the activist sixties which is remembered as a time of social disturbance and change in the United States. Minority groups demanded equal rights and poor people sought a way out of their poverty. The activism fell short of saving the world, but it did produce important gains for human rights. African Americans moved closer to true social equality. The most ambitious antipoverty program in American history was created. The Supreme Court created new legal safeguards for individual rights. In the United States, the African American civil rights movement blazed a trail of activism that others would follow. By the end of the 1950s, African-American activists had learned that changing the law was not enough. Somebody had to take the risk of putting those changes into practice. African American students had to enroll in previously all-white schools. African-American customers had to sit down at â€Å"white† lunch counters and wait to be served. Also, African-American voters had to register and then go to the polls on Election Day. In 1960 sympathetic whites and African-Americans that were tired of the segregation formed a committee named the Student Nonviolent Coordinating Committee (SNCC) to promote equality. The crusade for racial equality captured the imagination of many young people. On August 28, 1963, a quarter of a million people assembled at the Lincoln Memorial. Martin Luther King Jr., delivered the speech that was to become one of the most memorable orations in American history. A third of the people were white sympathizers of the African-American people. He delivered the speech â€Å"I have a dream† which moved people to fight for equality for everyone, it also became known as the â€Å"Movement† because it gathered momentum after the march on Washington. Human rights play an important role for civil disobedience. There were so many nonviolent protests because before the 20th century not everyone’s rights were being protected and being given equally. Due to Gandhi, King, and Thoreau they taught people in later generations to stand up for what is right. Now, women have the right to vote and children are treated equal and have been given rights.
